TERMS & CONDITIONS

Contractor Services

At the time of initial posting, Horst/Tymon has been selected as the official contractor to provide all services in the exhibit area. This is subject to change, at which time these terms will be updated to reflect a new General Contracting company. Complete information, including instructions, a schedule of prices regarding shipping, carpet for booths, labor for installation and dismantling, electrical service, furniture, etc., will be included in the Exhibitor Service Manual to be forwarded to exhibitors approximately 90 days before the conference. A Horst/Tymon representative will be available in the exhibit hall during all hours that the exhibit hall is open. Under no circumstances will YMR Music Productions, LLC. or the Branson Convention Center assume responsibility for loss or damage to goods consigned to the official contractor. Advance shipments of exhibit materials must be made to the official contractor as specified in the Exhibitor Service Manual. Should any shipment not be made as specified in the manual, it will be removed by Horst/Tymon and stored until the exhibit space is ready to accept materials for the exhibition and all costs involved will be charged to the exhibiting organization.

Arrangement of Exhibits

Any portion of an exhibit that obstructs the view or interferes with the privileges of other exhibitors, extends beyond the designated booth space, or for any reason becomes objectionable, must be immediately modified or removed by the exhibitor. The Show Management reserves the right to inspect the quality of the appearance of each booth prior to show opening.

Booth Design

Horst/Tymon, Inc. will provide side drapes 3' high and back wall drapes 8' high for all 10 x 10 booths. Standard, uniformly-styled booth identification signs featuring exhibiting organization name and booth number, will be provided. Show Management must approve any ceiling-hung signs. While equipment is excluded from height restrictions, it should be placed in the exhibit so as not to obstruct the view of neighboring exhibits. In the interest of all participating exhibitors, and to preserve uniformity, displays must conform to the limitations listed below:

Standard 10 x 10 Booths

Regular and specially built sidewalls including signs may not exceed 3' in height. If a high divider is desired, it cannot exceed 10' in height nor extend from the back wall more than one-half of the depth of the space. All display fixtures over 4' in height and placed within 10 linear feet of an adjoining exhibit, must be confined to that area of the exhibitor's space.

Each exhibitor will be provided with access to an online official Exhibitor Service Manual no less than 90 days prior to the event. A copy will be mailed only upon email or written request The manual describes the type and arrangement of exhibit space and the standard equipment provided by Horst/Tymon, Inc. for booth construction. All booth space must be arranged and constructed in accordance with the guidelines, provisions, and limitations contained in the Exhibitor Service Manual.

In the sole opinion of Show Management, if any exhibit fails to conform to the Exhibitor Service Manual guidelines or the provisions set forth herein, such exhibit will be prohibited from functioning at any time during the conference. Each exhibitor is responsible for keeping the aisles near its exhibit space free of congestion caused by demonstrations. All demonstrations or other promotional activities must be confined to the exhibit space, unless this has been discussed with Show Management prior to the start of the show. Sufficient space must be provided within the exhibit space for the comfort and safety of persons watching demonstrations and other promotional activities. Exhibitor space must be kept clear of waste.

Subleasing of Space

Exhibitors may not sublet their space, nor any part thereof, or make any arrangements for display by a non-exhibiting organization without the express written permission of the YMR Music Productions, LLC. No exhibitor shall have any non-exhibiting company set up in their booth. Company reps are welcome to work your booth but may not set up an additional display. In addition, no more than one company may occupy a standard exhibit space.

Fire, Safety, and Health

The exhibitor assumes all responsibility for compliance with local, city, and state ordinances and regulations regarding fire, safety, and health. All exhibit equipment and materials must be located within the booth. No combustible material will be stored in or around exhibit space, and the exhibitor must take all necessary fire precautions.

Sound Devices and Lighting

Public address, sound-producing, or amplification devices that project sound must not interfere with other exhibitors. Any form of attention-getting devices of presentations must be terminated when crowds obstruct aisles or infringe upon another exhibitor display. Show Management reserves the right to restrict the use of glaring lights or objectionable lighting effects. Music, whether instrumental or vocal, is limited to sound levels set by Show Management.

Delivery and Removal of Exhibits

Display space will be available for at a pre-determined time beginning Sunday, June 27, 2010. Notification of specific setup time will occur in the Exhibitor Manual. The exhibits will officially open at 4:00 PM on Monday, June 28, 2010. Exhibits will remain in place until 10:00 PM on Friday, June 2, 2010. By agreeing to this contract, any exhibitor that dismantles their booth prior to 10:00 PM on Friday, July 2, 2010 also agrees to forfeit their ability to have a booth at the 2010 Branson Gospel Music Convention. Dismantling of exhibits will occur on Friday, July 2, 2010 beginning at 10:00 PM (or close of concert) and on Saturday, July 3, from 7:00 AM until 11:00 PM. Under no circumstances will the addition to or removal of an exhibit be permitted during exhibit hours without express approval of an authorized Branson GMC staff member.

Promotional Items and Giveaways

Distribution of advertising materials, promotional items, and souvenirs must be confined to the exhibitor booth. Canvassing or distribution of advertising material or souvenirs in the exhibit hall by representatives of non-exhibiting organizations is strictly prohibited.

Storage

The exhibitor should make arrangements with Horst/Tymon for storage of packing boxes and crates during set up. YMR Music Productions, LLC., Branson Convention Center, and Horst/Tymon assume no responsibility for damage or loss of packing boxes or crates.

Food and Beverage

Distribution of food and/or beverages by exhibitors is prohibited, with the exception of wrapped candies.

Security

The Branson Convention Center provides general exhibit hall security. The doors to the hall will be locked at night. YMR Music Productions, LLC., Branson Convention Center, or Horst/Tymon make no warranty, expressed or implied, that the services it furnishes will avert or prevent occurrences, which may result in loss or damage.

Liability

YMR Music Productions, LLC., Branson Convention Center, or Horst/Tymon will not be liable for loss or damage to the property of exhibitors or their representatives or employees from theft, fire, accident, or other causes. YMR Music Productions, LLC., Branson Convention Center, and Horst/Tymon will not be liable for injury to exhibitors or their employees for damage to property in their custody, owned or controlled by them, which claims for damage, injury, etc., may be incident to or arise from, or be any way connected with their use or occupation of display space, and exhibitors will indemnify and hold harmless against such claim.

The exhibitor assumes all liability for any damage to the facility: floor, walls, lighting fixtures, etc., as a result of exhibitor negligence. The exhibitor will abide by and observe all laws, rules, regulations or ordinances of any government authority of the contracted facility.

The exhibitor will hold YMR Music Productions, LLC. Branson Convention Center and Horst/Tymon harmless from any and all damages, loss, or liability of any kind whatsoever resulting from injuries to persons or property occurring within the venue or property adjacent thereto occasioned by any act, neglect, or wrongdoing of the exhibitor or any of its officers, agents, representatives, guests, or employees, invitees, or other persons permitted by the exhibitor upon the premises, and the exhibitor will at its own cost and expense defend and protect YMR Music Productions, LLC. Branson Convention Center and Horst/Tymon against any and all such claims or demands.

Show Management

The exhibition is organized and managed by YMR Music Productions, LLC. Any matters not covered in this contract are subject to be interpreted by YMR Music Productions, LLC., and all exhibitors must abide by their decisions. Exhibitors must comply with the venue policies and procedures.

Trademarks

YMR Music Productions, LLC., Branson Convention Center, and Horst/Tymon will be held harmless for any trademark, trade name, copyright or patent infringement on any printed materials belonging or distributed by any exhibitor.

Booth Occupancy

Assigned booth space will rollover from year to year, subject to change with approval of YMR Music Productions, LLC. By leasing a booth space at Branson GMC, the exhibitor agrees to occupy the assigned space for the days listed on his/her registration form and according to posted hours. Late arrival or early exit not approved by YMR Music Productions, LLC, may subject exhibitor to forfeiture of future booth leasing, forfeiture of concert appearances, and additional fees.

Exhibitor Badges

Exhibitor or "Ministry Team" badges allow access to the concert hall and backstage areas. Each performing artist will receive one badge per performing member of a group; soloists will receive two badges total. There will be an additional fee charged for additional badges requested with the exception of: 1) Minor children of a performing artist, 2) Parents of a minor performing artist.

Businesses and organizations which are not performing during Branson GMC will receive badges based on staffing needs as assessed and agreed up between the exhibitor and Branson GMC management.

Failure to Occupy Space

Any exhibitor failing to occupy space is not relieved of the obligation of paying the full rental fee. Exhibitors space not occupied by 1:00 PM on Tuesday, June 29, 2010, will be subject to forfeit and may be resold, reassigned, or used by the exhibit management without refund.

Cancellation & Refunds

Once exhibit space has been selected, approved, and posted on the Branson GMC website there will be no full refunds for any reason of payments made for exhibit space or guidebook advertising. At discretion of YMR Music Productions, LLC, a partial refund may be given for what is considered to be extenuating circumstances if cancellation occurs no more than 30 days after registration. Exhibitor may cancel at any time but understands no refund will be given for exhibit space or advertising, including any payment that has already been tendered. Cancellation also does not relieve exhibitor / advertiser of liability of future payments due. Should an exhibitor cancel, his/her exhibit space, and exhibitor is also an artist, exhibitor will forfeit opportunity to appear at any time during Branson GMC. In addition, any exhibitor not supplying notice of cancellation and that does not occupy exhibit space may not be allowed to exhibit nor perform at Branson GMC 2010.

Conduct

All exhibits will be to serve the interest of conference attendees and will be operated in a way that will not detract from other exhibits or the conference as a whole. Additionally, all performances and exhibits must represent the Christian and ministerial nature of this event at all times.

Concert Appearances

YMR Music Productions, LLC, and the staff and committees of Branson Gospel Music Convention make it a goal and priority to schedule every registered artist for a single singing slot during the convention week based upon criteria formed by said staff and committees and available time. Schedule considerations and changes will not be made based on requests from artists, and changes may not be made without direct approval from an authorized staff member. Singing days and times are not guaranteed and are subject to change. Absolutely no refunds will be given based on the scheduling of an artist.

Branson GMC Promotional Materials

By agreeing to these terms, you agree to have your name, website, and/or likeness used for the promotion and advertising of Branson Gospel Music Convention.
